1. About this agreement

1.1. This user Agreement is the agreement between individuals (Users) who register in the Service and the Developer of Service (Individual Entrepreneur Zbykovskyi Ivan, registered in accordance with the legislation of Ukraine, state registration number - 872704), and contains the terms and conditions of use this Service.

1.2. This Agreement is a single document together with the , as well as the .

1.3. When Signing Up at the Service, you must read and agree with this Agreement and all annexes to it. If you disagree with the Agreement, you must IMMEDIATELY STOP using this Service.

2. Glossary

2.1. Service - a website, located at the address or (including all applications for desktop and mobile devices), which is developed and owned by the individual entrepreneur Zbykovskyi Ivan, which provides medical content for informational purposes ONLY which is not a full substitute for professional medical advice or treatment.

2.2. Developer - individual entrepreneur Zbykovskyi Ivan, who is registered in accordance with the legislation of Ukraine, and has a state registration number - 872704.

2.3. User - an individual over 18 years old who is registered in the Service and using the functionality of this Service:

2.3.1. Network Member - User who has registered with the Service as a Network Member.

2.3.2. Specialist - a User, who has a mandatory higher medical education and relevant government documents, which gives the right to practice medicine, and who is Signed Up in the Service with the role of a Specialist.

2.4. Artificial Intelligence (AI) - is a specially developed and pre-trained computer program that provides medical information for informational and recommendatory purposes ONLY based on text User`s data.

2.5. Content - any information published within the Service by any User or by the Developer.

2.6. Medical advice (medical consultation) – is the process of providing medical information for the recommendatory and informational purposes ONLY using the technical capabilities of the Service.

2.7. Registration (Signing Up) - is the procedure of creating an User`s account within the Service. After registration User is provided with personal access to the functionality of the Service.

2.8. - is the process by which an artificial object is deconstructed to reveal its designs, architecture, code or to extract knowledge from the object.

2.9. - is the process of searching and analyzing any pages or components of this Service in order to populate information about them into a database that is different from the database of this Service.

3. About the Service

3. About the Service 3.1. This Service is developed to help people find a way to recovery and a fulfilling life. Users can search for other Network Members with similar symptoms and health problems, take online consultations with Specialists, as well as with the specially developed Artificial Intelligence BUT ONLY for obtaining medical information for informational and recommendatory purposes.

3.2. This Service is NOT intended for providing medical care and NOT for medical treatment in terms of the legislation of any country of User who uses the Service is a citizen of.

3.3. All Users of the Service, including Specialists, are NOT Developer`s employees hired under any labor agreements, contracts, etc. Any information from these persons is their personal opinion and is not the opinion of the Developer.

3.4. Presence of any Users, including Specialists in the Service, does not denote their qualifications and any professional qualities. Information is provided "as is" in the form it is provided by the Users, including the Specialists.

4. Content of the Agreement

4.1. Users are allowed to use the functionality and Content of the Service ONLY on the terms that are described in this Agreement.

4.2. The Agreement enters into force from the moment when User agrees with the content of the Agreement during the Registration process.

4.3. The Agreement and any of its annexes can be changed at any time by the Developer without notifying the Users about it.

4.4. After the User check the checkbox of acceptance of the terms of this Agreement during the Registration procedure in the Service, the User is considered to have accepted the terms of the Agreement in full, without any exceptions.

4.5. When using any Service functionality the User is considered accepted the terms of the Agreement with the content determined precisely at the time of using the Service, and not at the time of Registration of this User, even if another version of the Agreement was in effect at the time of Registration. If the User disagrees with any of the statements of the Agreement, he is obliged to IMMEDIATELY STOPM using the Service.

4.6. By accepting this Agreement, any of the Users confirms that they are capable and of a legal age.

4.7. By accepting this Agreement, the Specialist confirms the authenticity and reliability of all the information and documents provided during the Registration process.

5. Registration Process and User Account

5.1. Access to the Service can be obtained ONLY after registering User account in the Service.

5.2. Registration of the User is allowed only for individuals over 18 years old.

5.3. When registering, the User confirms that he will NOT use his account for any illegal actions.

5.4. When registering an account, the User agrees with the processing of his Personal Data, including photos, data about his health status, payment data, etc.

5.5. You are able to Sign Up at the Service on behalf of another person, but ONLY on the condition that this other person is not physically able to use the functionality of this Service or has not reached the age of 18.

5.6. During the Registration of the User a timestamp and the fact of the User's consent with the contents of the Agreement are stored in the internal database of the Service.

5.7. During the Registration and further work with the Service, the User is obliged to provide accurate, truthful and up-to-date information about themself.

5.8. For the Network Member a valid e-mail address is mandatory for Registration.

5.9. Individuals who meet the criteria set denoted in clause 2.3.2 may submit a Registration request to the Service as a Specialist, however, this does NOT guarantee successful completion of the Registration. Any Registration request of a Specialist at any time may be subject of documents verification for their authenticity and compliance with the criteria of this Service. For the Specialist, the following are mandatory for Registration: valid e-mail address, phone number, valid profile photo, full name, date of birth, gender, data of higher medical education and state-recognized documents that give the right to practice medicine, as well as the data about medical experience and practice etc.

5.10. Data required for Registration are marked in a special way. Any other information which provided by the User of the Service at his request and is not mandatory for the Registration or use of the Service, however, the more information the User provides, the more likely other Users, Specialists or Artificial Intelligence will provide the most relevant information.

5.11. If the Developer will suspect that the User's data is unreliable, the account is used for illegal purposes or by a third party, the bank card specified by the User does not belong to him or the User in any other way violates the terms of this Agreement, then the Developer will block the User's account.

5.12. If the User suspects that his personal data specified in the account was stolen and / or fraudulently used by a third party, then this User is obliged to inform the Developer about this. The Developer is not responsible for any fraudulent use of any personal data, including medical data and data on payment cards by third parties in the User's account of the Service. If you think that a third party has gained unauthorized access to your account, IMMEDIATELY inform the Developer at support@victoriasmedical.ai.

. Terms of use the information received from the Service

6.1. Any information that is received from the Service, including online consultations with a Specialist, another Network Member or with Artificial Intelligence, is for recommendatory and informational purposes ONLY and is NOT an incentive to take any action.

6.2. Any information from the Service, including diagnoses and recommendations for any type of treatment from other Network Members, Specialists or Artificial Intelligence, is for recommendatory and informational purposes ONLY and can be used AT YOUR OWN RISK.

6.3. Using of the Service does NOT make the User a patient in the terms defined in the legislative acts of the country of which the User of the Service is who uses it.

6.4. When taking Medical Advice in the Service, each User agrees that the Specialist, another Users, or even more Artificial Intelligence are NOT his doctor in terms of the legislation of the country of which the User is a citizen of.

6.5. All Users of the Service undertake not to use the Service as a complete substitute for the treatment prescribed by their physician.

6.6. Before taking any action based on the information obtained from the Service, all Users should take advice of their physician.

7. Limitation of Liability and Warranties

7.1. The Developer disclaims absolutely all guarantees and does not accountable to the Users of the Service for any decisions or actions that can be or were carried out using the information received from the Service.

7.2. The Developer DOES NOT guarantee the accuracy of the Service Content.

7.3. The Developer DOES NOT change and is NOT responsible for any information provided by Specialists, Network Members or Artificial Intelligence.

7.4. The Developer DOES NOT give any guarantees and DOES NOT accountable for the quality of the information provided by other Users of the Service, Specialists and AI.

7.5. The Developer DOES NOT accountable for the information, software, data, privacy policy associated with absolutely everything outside of this Service.

8. Privacy

8.1. All personal and confidential information of absolutely all Users is stored in the cloud and is protected from fraud, theft and unauthorized access using the latest encryption and crypto protection technologies.

8.2. This Service is the HIPAA compliant regarding the storage of personal medical information.

8.3. Any of the Users is STRICTLY FORBIDDEN to disclose any information, including the personal data of other Users, as well as any confidential information posted or said during online consultations with other Users.

9. License and copyright

9.1. When using this Service, the Users are STRICTLY FORBIDDEN:

9.1.1 remove any mention of copyright, trademark or other copyright holder's notice in any part of this Service;

9.1.2 reproduce, modify, develop derivative IT products and services based on this Service, distribute, transfer the rights to use the services, rent, sell, resell the services of this Service, if the Developer has not given the appropriate permission to do so;

9.1.3 use or distribute any Content of the Service for commercial purposes;

9.1.4 decompile, make Reverse Engineering of this Service, except as otherwise provided by applicable law;

9.1.5 mirror any part of the Service or create a copy of any part of the Service;

9.1.6 Crawl any part of this Service, with the exception of search robots listed at , in order to collect personal information about other Users as well as any Content of the Service;

9.1.7 execute or run any programs or scripts for the purpose of cleaning, indexing, reviewing or collecting data from the Content of any part of this Service;

9.1.8 perform any actions leading to blocking the execution and / or limiting the functionality of this Service;

9.1.9 attempt to gain unauthorized access to this Service or related systems or networks;

9.1.10 post Content that has traces of pornography, vulgarity, racial, ethnic and any other discrimination, is harmful, is associated with violence, obscenity, infringes on the inviolability of privacy;

9.1.11 post advertising or commercial information.

10. International Users

10.1. Developer DOES NOT guarantee that the information on the Service is appropriate for use by Users outside of the Ukraine.

10.2. By using this Service, you agree that your personal and any other data will be processed in accordance with the legislation of Ukraine and our and may be displayed to other Users outside the jurisdiction of the country you are a citizen of.

11. Arbitration

11.1. In order to resolve various kinds of issues, any of the Service Users should write to the Developer at the email address support@victoriasmedical.ai.

11.2. Relationship between the Developer and User of the Service is governed by and interpreted in accordance with this Agreement and with the legislation of Ukraine. Regardless of the place of residence / location of the parties, any disputes between the parties are resolved in accordance with the legislation of Ukraine.
